IN THE NAME OF GOD AMEN, the fourth day of August in the seventeenth year of the reign of our sovereigne Lord King Charles the second over England etc Anno Domini 1665, I, RICHARD AMIS of Molash, in the County of Kent, yeoman, being somewhat weak and sick in body but of sound and perfect memory (praised be God therefore) do make and ordain this my last Will and Testament in manner and form following,
FIRST, I bequeath my soul to Almighty God my Creator trusting to be saved by the all sufficient merrits of my alone Saviour and Redeemer Jesus Christ, and my body I commit to the earth (from whence it was taken) to be decently buried at the discretion of my Executors hereafter named, And as for my wordly goods with which God of his infinite goodness and mercy hath blessed me with, I give and dispose of the same in manner and form following.
First, I give, devise and bequeath unto my oldest son JOHN AMIS all that my messuage and lands situate lying and being in Molash aforesaid called Puntice with all and singular the apapurtenances thereunto belonging or in any wise appertaining or there withall used, occupied or reputed as part, parcel or member thereof, to have and to hold to him and his heirs forever,
Also, I give, devise and bequeath unto him my said son JOHN AMIS all that my little piece of land called Jeakes situate in Molash aforesaid with the appurtenances to the same belonging.
Also, I give and bequeath unto him my said son JOHN AMIS all that my messuage and lands wherein I now dwell called Philpotts situate lying and being in Molash aforesaid withall and every the appertenances thereunto belonging or appertaining or therewith used, occupied, reputed or enjoyed as part parcel or member thereof.
Also, I give and devise unto my said son JOHN AMIS all that my piece or parcel of pasture land lying in Molash aforesaid called Molash Craft which I purchased of the Wanstalls.
Also, I give and devise unto the said JOHN AMIS the Northend of my orchard belonging to my messuage or tenement hereafter mentioned called Barlings containing by estimation one rood of land be thereof more or less leading from the corner of the barn there to a dowle stone standing in the hedge belonging to a certain field there called the Barley field and from the corner of the hog sty there to the lower post of the street gate, to have and to hold the said messuage severall pieces or parcels of land and premises last mentioned with the appurtenances unto my said son JOHN AMIS and to his heirs forever. And my will and meaning is concerning the same that he shall not sell, alien or dispose of the same or any part or parcel thereof or of any other the messuage, lands and premises hereby by me to him given and devised at any time or times hereafter other than to his children of his body lawfully begotten or to be begotten.
Item, I give, devise and bequeath unto my two youngest sons, THOMAS AMIS and RICHARD AMIS and to their heirs forever all that my messuage, lands and premises with the appurtenances called Barlings which I purchased of Henry Goately (excepting only the north end of the said orchard containing by estimation one rood of land which I have as before given and bequeathed to my said son JOHN AMIS and to his heirs forever) all which said messuage and lands to be by them had and holden at their several ages of one and twenty years and the rents and profits thereof yearly arising of and from the same my will and mind is shall be received and paid to my loving wife, ELIZABETH, for and towards the bringing up of my said two sons THOMAS and RICHARD and my youngest daughter HANNAH until my said two sons shall attain their several ages of one and twenty years as aforesaid. And if either of my said two sons THOMAS and RICHARD die before his or their said age of one and twenty years then the son so surviving to be the others' heir.
Item, I give and bequeath unto my said daughter HANNAH the sum of twenty pounds of lawful money of England to be paid to her at her age of one and twenty years by my said sons THOMAS and RICHARD or one of them and to be raised out of the rents, issues and profits of my said messuage and lands called Barlings.
Item, I give and bequeath unto my daughter JANE AMIS all that my annuity or yearly rent of six pounds issuing and going out of a house and land in Pett Street in the parish of Wye in the aforesaid County of Kent belonging unto John Philpott or his assigns, to be taken, received and enjoyed by her during her natural life with all arreages thereof if any happen to be at the time of my decease and after her decease I give the said annuity or yearly rent of six pounds unto my said son JOHN AMIS and his heirs and assigns forever.
Item, I give and bequeath unto my granchild ELIZABETH WILSON the yearly rent or sum of three pounds of lawful money of England yearly to issue and be paid out of my messuage and land called Puntice to be paid unto her or her assigns quarterly every year during her natural life. And for non-payment thereof at the four usual feasts or terms in the year (that is to say) the Feast of St. Michael Tharchangel, the nativity of our Lord and Saviour Jesus Christ, the annunciation of our blessed Lady St. Mary the virgin and St. John the Baptist by even and equal portions or within fourteen days next after any of the said feasts it shall and may be lawful for her the said ELIZABETH WILSON or her assigns to enter and distreyne in and upon the said messuage and land or any part thereof and the distress and distresses thereto taken and had to detain and keep until she shall be satisfied the said rent or sum of money and all arrearages thereof and all costs and damages by that occasion had and sustained the first payment thereof to be and begin at the first of the feasts days of payment next after my decease.
Item, I give and bequeath unto my grandchild DEBORAH BARGRAVE the sum of fifty pounds of like lawful money of England to be paid unto her at her age of one and twenty years.
Item, I give and bequeath unto ELIZABETH my said wife all her wearing apparrell both linen and woollen and all such household stuff as she brought to me (that is to say) one trunk, one high clothes press, one trundle bedsted with the bed thereto belonging, two coverlets and also all the linen which she hath made since our marriage together and also the sum of ten shillings of lawful money of England to be delivered and paid to her by my Executors immediately after my decease.
Item, I further give and bequeath unto my foresaid son JOHN AMIS all other the household stuff, cattle and corn which I shall be possessed of at the time of my decease.
All the residue of my goods, chattels, money, bonds, bills, mortgages, annuities or other debts due to me I give and bequeath (after my debts, legacies and funeral expenses paid and discharged) unto my said son JOHN AMIS and my son-in-law ROBERT LUCAS equally between them two to be divided.
And I do hereby make, constitute and ordain them the said JOHN AMIS and ROBERT LUCAS Executors of this my present last Will and Testament they paying and discharging all and every my legacies in money hereby by me given and bequeathed (excepting those that I have otherwise herein ordered to be paid).
Item, my will and mind further is that if my said wife ELIZABETH happen to be with child at the time of my decease and the child or children happen to be born and live to the age or ages of one and twenty years that then I do hereby give, will and bequeath unto him, her or them the sum of twelve pence of lawful money of England apeice at their said age or ages of one and twenty years.
And that in respect I was promised by my father-in-law CHRISTOPHER GOTELY as a marriage portion with my said wife the sum of one hundred pounds which was never paid me and therefore I do hereby desire him that he will pay the same to my said wife's children.
And lastly I do hereby make void and null all former and other Wills and bequests and do publish, ratify, confirm and declare this to be my only last Will and Testament.
AND IN WITNESS WHEREOF I have to the first sheet thereof set my mark and to this second and last sheet thereof my hand and seal dated the day and year first in this my last Will written.
