      IN THE NAME OF GOD, AMEN, the third day of April in the three and twentieth year of the reigne of our Sovereigne Lord Charles the Second by the grace of God, King of England, Scotland, France and Ireland, defender of the faith and Anno Domini 1671, I, ROBERT TYLBIE, of Lenham, in the County of Kent, yeoman, being sick and weak in body but of sound, perfect and disposing mind and memory (praise be given to God therefore) do for the quieting of my mind and settling that estate which God of his mercy hath afforded me, make and ordain this my last Will and Testament in manner and form following:

      First and principally I bequeath and surrender up my soul into the hands of Almighty God my Creator believing to be saved by and through the only merits and satisfaction of Jesus Christ my only Saviour and Redeemer, and my body I commit to the earth from whence it came to be decently interred by and at the discretion of my executors hereafter named.

      Also I give and bequeath to my well-beloved wife ANNE TYLBIE the rents and profits of all that my house and land in Appledore for and during the term of her natural life towards her support and maintenance and after her decease I do give and bequeath the same unto my three sons, GEORGE TYLBIE, THOMAS TYLBIE and HENRY TYLBIE and to their heirs forever to be equally divided between them when they shall attain to their several ages of one and twenty years, and if it shall happen that either of my said three sons aforenamed shall die or depart this life before he or they shall attain to the age of one and twenty years aforesaid, that then my will and mind is the survivor or survivors shall be heirs to him or them decesased. Nevertheless my will and mind is that if it shall please God that my wife aforesaid shall happen to live till all my three sons aforesaid shall have attained to their several ages of one and twenty years as aforesaid that then neither of my three sons aforesaid shall have or claim any right or title to all or any part of the rents or profits of the lands aforesaid till after the death of my loving wife, ANNE TYLBIE, aforesaid. And if it shall happen that my three sons aforesaid shall all of them depart this life before they shall come to their several ages of one and twenty years, then I do and bequeath my said house and lands in Appledore aforesaid to my three sons, HUGH TYLBIE, ROBERT TYLBIE and JOHN TYLBIE and to their heirs forever.

      Item I give and bequeath unto my daughter, ANNE TYLBIE, the sum of thirty pounds of lawful money of England to be paid to her by my executors hereafter named when she shall attain to her full age of twenty years and my will and meaning is that my Executors shall freely keep and maintain my said daughter, ANNE TYLBIE, till she shall be of sufficient growth and ability to go into service and get her own living and that my said daughter, ANNE TYLBIE, may be the better secured of the said sum of thirty pounds by me given and bequeathed to her as aforesaid, and for the sure payment thereof to her when she shall attain to the age of twenty years as aforesaid, I will, order and appoint my very loving brother, LIBBENS TYLBIE, of Lenham, aforesaid, linen weaver, to take such security for the payment thereof unto my said daughter as unto him shall be thought fit and in default thereof I will and order my said Executors to pay unto my said brother, LIBBENS TYLBIE, for the use of my said daughter the said sum of thirty pounds of like lawful money of England six months next after my deceased to the end, intent and purpose that the said LIBBENS TYLBIE shall secure the payment of the said thirty pounds to the said ANNE my daughter as before is appointed, and the interest to pay or cause to be paid to my said loving wife during the term of her natural life.

      Item I give and bequeath unto my well-beloved wife, ANN TYLBIE (in case my Executors should be unkind, vex or disquiet my said wife so that she shall rather choose to live by her self or with some other friend then with them) my best bed, bedsteddle, matt and cord, three pair of sheets and all other necessaries belonging to it with so much of my other household stuff as fit and convenient for the furnishing of one room for her own private use and my meaning is that the other household goods above mentioned to be given to my wife shall be all or so much of the linen and goods which was hers by her grandfather and friends before our marriage.

      Item I give and bequeath unto ROBERT SKIRE my daughter’s son the sum of five pounds of lawful money of England to be paid to him by my Executors when he shall attain to the age of one and twenty years

      Item all other my goods, debts, ready money, household stuff, chattels, cattle, corn and whatsoever is not before in this my last Will and Testament given and bequeathed I do give and bequeath to my three sons, HUGH TYLBIE, ROBERT TYLBIE and JOHN TYLBIE, whom I do hereby make Executors of this my last Will and Testament, they paying my debts and legacies, funeral expenses and I do make the said LIBBENS TYLBIE overseer of this my last Will and Testament, desiring him to be aiding and assisting to my Executors in the due performance of this my Will and that they faithfully perform the trust by me in them reposed by this my last Will and I do hereby renounce and make void all former Wills by me formerly made.

      IN WITNESS WHEREOF I the said ROBERT TYLBIE have to this my last Will and Testament containing four sheets of paper have to every sheet set my usual mark and affixed them all together by a laybond with my seal in it at the top of them which was set and put the day and year first above written

      PROBATE made of the above written Will of ROBERT TYLBIE the first day of November 1671 before William Lovelace, Clerk Surrogate to the worshipful William Stede, Doctor of Laws, Official General to the Reverend, the Archdeacon of Canterbury, lawfully constituted by the oath of HUGH TYLBIE, son of the deceased and one of the Executors named in the said Will he being first sworn duly to perform the same, etc.
