      Will of Laurence Omer, Gentleman, of Staple, Kent, dated 24 May 1637, proved 23 June 1637


      IN THE NAME OF GOD AMEN, the four and twentieth day of May in the year of our Lord God 1637, I, LAURENCE OMER, of Staple, in the County of Kent, gentleman, being sick in body but of good and perfect memory thanks be to God do make and ordain this my last Will and Testament In manner and for, following, that is to say:


      First, I commend my soul into the hands of my only Lord and Saviour Jesus Christ by whose only merits and blood shedding I believe verily to be saved and come to eternal life and my body to be buried in the churchyard of Staple aforesaid near to the corpse of my grandfather, ETHELBERT OMER, there lying and for my temporal estate wherewith it hath pleased God to bless me in this world, I dispose in manner and form following:


      First, my will is that all my goods, stock and cattle whatsoever (my funeral expenses being discharged) shall be employed toward the satisfaction and payment of my debts.


      Item, I give and bequeath unto my daughter ANNE OMER all the profits of my lands lying in Ash Wingham, Chillenden, Goodnestone, Hoade [Hoath] and Hearne until my son, LAURENCE OMER, shall attain and come unto the full age of one and twenty years excepting always out of the profit of the said lands all such monies as shall serve to make full satisfaction for my debts with my goods and stock and cattle aforesaid shall not amount unto to pay and discharge And also excepting unto my Executrix hereafter named out of the profit of the said lands beforementioned the sum of thirty pounds a year towards the bringing up of my said son and daughter, LAURENCE and ANN OMER during the said terms.


      Item I make my loving wife, MARY OMER, full and sole Executrix of this my last Will and Testament Provided always that if my said Executrix, MARY OMER, my wife, shall happen to marry again after my decease before my said son LAURENCE OMER shall attain and come to the said age of one and twenty years then my will is that she shall make a true and inst account unto my loving father, LAURENCE OMER for the rents and profits which she shall have then retained before the time of the said marriage and shall also pay all such sums of money which she shall have then retained before the time of the said marriage ---------- for the rents of the said lands unto the said LAURENCE OMER my father before the time of her said marriage if the said LAURENCE OMER my father shall be then living and after her said marriage she shall not receive any further profits for the rents of the said lands but my said father, LAURENCE OMER shall take and dispose of the said rents for the best benefit of my said children with the term before prefixed. Provided always also that if she the said MARY OMER my wife shall refuse the said executrixship and to perform this my last Will and Testament in manner and form and in all points as is before expressed then my mind and will is that my said father, LAURENCE OMER, shall be full Executor of this my Will to perform and fulfill the same and that he or his Executors or assigns shall take all my goods, stock and cattle before mentioned and all the profit of my said lands for the payment of my said debts bringing up my said children and raising of a portion for my daughter ANN OMER according to the will and discretion of the said LAURENCE OMER my father and that then the said MARY OMER my wife shall not meddle at all with any of my said goods, stock, plate, cattle nor profits of my said lands anything contained in these presents to the contrary in anyways notwithstanding.


      Item, I give and bequeath unto my said son, LAURENCE OMER all my said lands aforementioned in Ash Wingham, Chillenden, Goodnestone, Hoade and Hearne when he the said LAURENCE OMER my son shall attain and come unto his full age of one and twenty years to have and to hold the said lands above bequeathed unto him the said LAURENCE OMER my son and to his heirs forever.

      Item I do entreat my loving uncle, WILLIAM BING, Gent, Captain of His Majesty’s Castle of Deale to be overseer of this my last Will and Testament and to see the same carefully to be executed and performed.

      IN WITNESS WHEREOF I have hereunto set my hand and seal the day and year first above written

      Memorandum that these words (shall be full executor of this my last Will to perform and fulfill the same and that have) were interlined above the six and twentieth line before the signing and sealing of these presents and after it they were signed and sealed by the testator LAURENCE OMER in the presence of Edward Fellow, Stephen Gibbe, John Allportly[?] his mark, Andrew Neale.

      PROBATE granted 23 June 1637 to MARY OMER.
