      Will of Thomas Austen, Clerk, of Harbledown, made 15 Aug 1661, proved 1 Nov 1661.

      IN THE NAME OF GOD AMEN, the fifteenth day of August in the year of our Lord God one thousand six hundred sixty and one, I, THOMAS AUSTEN, of Harbledown in the County of Kent, Clerk, being of whole and firm mind, and of good and perfect remembrance thanks be to Almighty God therefore do make and ordain this my last Will and Testament in manner and form following That is to say

      First I commend my Soul unto Almighty God my Maker trusting to be saved by the only merits of jesus Christ my blessed Redeemer. And my body to be buried at the discretion of my Executrix hereafter mentiond.

      As for my worldly goods and chattels I dispose of them in manner as followeth,

      Imprimis it is my will and appointment that the legacy bequeathed by my father MATHEW AUSTEN of Wye in the County of Kent aforesaid deceased in his last Will and Testament unto ELIZABETH AUSTEN the daughter of HENRY AUSTEN deceased be paid her by my Executrix hereafter mentioned out of the goods which I shall leave and by this my last Will and Testament bequeath unto my Executrix herafter in these presents mentioned when the said legacy shall become due and payable according to the true effect purport and meaning of my father's said last Will and Testament And that the legacy of forty shillings by the year bequeathed by my father unto my uncle RICHARD AUSTEN of Wye aforesaid be yearly paid him during the terms of his natural life at the feast of St Michael the Archangel and of the Annunciation of the Blessed Virgin Mary by even and equal portions according to the tenor and true effect of my father's said last Will. And if default of payment shall be made thereof by the space of fifty days next after any of the said feasts in which the same ought to be paid then I do will and grant that it shall and may be lawful to and for the said RICHARD AUSTEN and his assigns into my messuage lands and tenements of Wye aforesaid to enter and distraine and the distress and distresses then and there found to lead, drive, take and carry away detain, impound and keep until the said forty shillings by the year and the arrearages thereof if any be be unto the said RICHARD AUSTEN and his assigns well and truly satisfied contented and paid.

      Item, it is my will and appointment that the two legacies of forty pounds apiece given and bequeathed by my father aforesaid in his last Will and Testament unto my two daughters ANNE and JANE be paid unto them when they shall attain unto their ages of one and twenty years respectively. An for the payment and full satisfaction of the said legacy of forty pounds unto my daughter ANNE AUSTEN aforesaid I do hereby appoint and charge the mortgage of one piece or parcel of land called Bowerland field otherwise Bourneland being parcel of the manor of Dingley otherwise called Bowerland situate lying and being in the parish of Chilham in the said County of Kent containing by estimation nine acres more or less which said piece or parcel of land my uncle THOMAS AUSTEN of Chilham aforesaid mortgage unto me for security of forty pounds ( as by a pair of indentures further appeareth bearing date the ninth day of December 1659) And for the payment and full satisfaction of the said legacy of forty pounds unto my daughter JANE (if money for that purpose cannot be raised by my Executrix hereafter mentioned) then I do give and bequeath unto her the said JANE and her heirs one piece or parcel of pasture land commonly called or known by the name of Middlefield otherwise four acres situate lying and being in the parish of Wye aforesaid abuttting on a piece of land of mine called Greenfield and Sheriffs Croft towards the southeast and on a piece called Weltons towards the southwest and to a lane called Crabb Lane leading to other lands of mine towards the northwest.

      Item, whereas by an Indenture bearing date one or about the seventh of April in the year of our Lord God 1653 made between me the said THOMAS AUSTEN of the one part and JOHN MOORE of Clavering in the County of Essex, Clerke, and EDMOND HUMFRY of Clavering aforesaid yeoman of the other part three pieces or parcels of land called or known by the name of Broadeleeze and Bassants Croft containing by estimation eighteen acres more or less lying and being in the parishes of Wye and Brooke in the said County of Kent or in one of them, are settled or meant or mentioned to be settled to the use of me the said THOMAS for my natural life and after my decease to the use of JANE my loving wife for the term of her natural life And to other uses in the said Indenture mentioned Now for the avoiding all doubts if any should arise about the said settlement I do hereby give and devise unto my said loving wife JANE the said three pieces or parcels of land for the term of her natural life And after her decease I give and devise the same to my said two daughters ANNE and JANE and to the heirs of their two bodies lawfully to be begotten. But if either of my said daughters shall die before she hath attained the age of one and twenty years without issue of her body living at the time of her death then I give and devise the said three pieces of land to the survivor of them and to their heirs of the body of the said survivor And for want of such heirs then I give and devise the same to the heirs of the body of the said JANE my now wife and for default of such heirs to the right heirs of mine the said THOMAS AUSTEN.

      Item, I give and devise unto the said JANE my now wife for and during the term of her natural life two other pieces or parcels of land commonly called or known by the name of Sofright otherwise the Six acres and the Nine acres or the eight acres containing in all by estimation fourteen acres more or less with the appurtenances lying and being in Wye aforesaid late purchased of MATTHEWE AUSTEN and HENRY AUSTEN. And after her decease I give and devise the same unto my said daughters ANNE and JANE and to their heirs of their two bodies lawfully to be begotten And for want of such heirs to my said wife and of her heirs forever unless my wife be now with child And if my wife be now with child of a boy then I give and bequeath the same two pieces of land after the decease of my said wife to the said boy and his heirs. But if my said wife be now with child of a girl then I give and devise the same two pieces or parcels of land to the same girl and her heirs.

      Item, I give and bequeath unto my said wife for the term of her natural life if she continue so long and unmarried all those two other pieces or parcels of land commonly called or known by the name of Poarke otherwise Sparkefield or Eastcroft containing by estimation eleven acres and an half more or less lying and being in the parish of Wye aforesaid and after the decease or second marriage of the said JANE my wife or which of them shall first happen I give and bequeath the same unto my said two daughters ANNE and JANE and to the heirs of their two bodies lawfully to be begotten And for want of such heirs to my said wife and of her heirs forever unless my said wife be now with child And if she be with child of a boy then I give and devise the same two pieces or parcels of land to the said boy and to his heirs But if my wife be now with child of a girl then I give and devise the same two pieces of land to the said girl and to my said two daughters and to their heirs

      Item, the better to enable my said wife to educate and bring up my said children and to pay and discharge the legacies in this my last Will mentioned I give and devise unto my said wife JANE all my messuage barnes outhouses at Wye aforesaid together with all other my lands not before in this my Will devised or mentioned until my said daughter ANNE shall attain her age of one and twenty years. And then I give and devise the same unto my said daughters ANNE and JANE and to their heirs.

      Item, I give twenty shillings to be laid out in bread and distributed amongst the poor of Harbledown by and at the discreation of my Executrix.

      Item, all the rest of my goods and chattels, plate and ready monies (my debts and legacies being first paid) I give and bequeath unto my said loving wife JANE whom I make and ordain sole and only Executrix of this my last Will and Testament.

      Item, I do request MR. WILLIAM BROADNAX of Godmersham, MR. ROBERT BEAKE late Minister of Hackington and my cousin MATHEWE AUSTEN of Faversham to be overseers of this my last Will and Testament and to be aiding and assisting my said wife in the execution thereof.

      IN WITNESS WHEREOF I the said THOMAS AUSTEN have to every sheet of this my last Will and Testament consisting of three sheets of paper set my hand and seal the day and year abovesaid.

      Probate of the above written Will of Mr. Thomas Austen, Clerk, by the oath of JANE AUSTEN relict of the said deceased and Executrix named in the same Will was approved in respect thereof and the said Executrix was entrusted and first sworn in the form of law and touching [God’s holy gospels], etc., saving the right of anyone else to execute
